$6.8 Million for Child with Cerebral Palsy and Cognitive Deficits due to Mismanaged VBAC & Cord Compression | Cerebral Palsy Lawyers

The Detroit cerebral palsy attorneys at ABC Law Centers won a $3.75 million settlement (total annuity payout: $6.8 million) for a child injured by medical staff’s mismanagement of a vaginal birth after C-section and cord compression.

Early in pregnancy, plaintiff was informed by her midwife that she was a “good candidate” for VBAC (Vaginal Birth After C-section), despite numerous risk factors (morbid obesity, recent C-section, single layer incision, prior C-section for fetal distress). At full-term, another midwife broke the plaintiff’s water to induce labor. After the rupture of the membranes, umbilical cord compression occurred and fetal heart monitor tracings were non-reassuring. The midwife called for physician assistance. C-section was discussed and plaintiff consented. An amnioinfusion (fluid injected into amniotic sac) was done to attempt to relieve umbilical cord compression and fetal distress. There was some improvement and plaintiff child was born vaginally a few hours later.  Unfortunately, the delivery occurred too late.  Failure to perform an emergency C-section at the first signs of fetal distress caused the child to experience a lack of oxygen for too long. Cord blood gases were within normal limits but head imaging done several days later suggested birth asphyxia (hypoxic ischemic encephalopathy). Today, the child has severe cerebral palsy (CP) and cognitive deficits. She is unable to walk and has a feeding tube.  The Detroit, Michigan cerebral palsy lawyers at ABC Law Centers obtained $3.75 million for this little boy who was injured because the medical team failed to quickly deliver the baby when there was fetal distress caused by umbilical cord compression in a high-risk pregnancy.
