Pennsylvania Birth Injury Attorneys
Helping families like yours since 1997
Pennsylvania birth injury attorneys who are here for your family.
A birth injury diagnosis is difficult on your whole family. When something goes wrong at birth, your family must cope with the lasting consequences of a birth injury.
Birth injuries can involve:
- oxygen deprivation
- hypoxic-ischemic encephalopathy (HIE)
- Trauma during labor and delivery
- a long NICU stay
- Infant seizures
- infections
They can lead to lifelong disabilities, such as cerebral palsy (CP) and developmental delays. Children with birth injuries may miss milestones.
It can be scary if the medical staff you trust with your care make mistakes that lead to birth injuries. No one deserves pain from malpractice or negligence. If you believe that your baby experienced a birth injury in Pennsylvania, call us. A lawsuit can cover your child’s care for their lifetime.

How do I know if I have a medical malpractice case?
Pennsylvania is home to highly-ranked obstetrics and neonatal care programs. However, even at top hospitals, medical errors may happen. Pennsylvania has dozens of NICUs (neonatal intensive care units) located within the state. Nearly all babies with birth injuries go to the NICU for medical care.
Many birth injuries are preventable. Attorneys can hold the hospital accountable for failing to prevent these injuries. If you are unsure if malpractice or negligence occurred, an attorney can help determine what happened to your child.
If there is any uncertainty about what happened during or after your child’s birth, give us a call. Our attorneys and in-house medical professionals can help you. We will uncover the full story, evaluate your medical records, and explain your legal options.
Why should I hire a Pennsylvania birth injury lawyer from ABC Law Centers: Birth Injury Lawyers?
At ABC Law Centers: Birth Injury Lawyers, birth injury is all we do. Our team focuses only on birth injury cases. We work closely with a network of trustworthy birth injury attorneys nationwide and partner with local co-counsel for cases.
Many personal injury law firms advertise that they take birth injury cases. However, those firms may not have much experience with birth injury. These cases are a complex type of medical malpractice. You want to choose a firm experienced with birth injury cases, not car accident cases or dog bites.
Our team has worked with countless families like yours across the country. The attorneys at ABC Law Centers: Birth Injury Lawyers are well-known in the field of birth injury. Our team has earned many awards, honors, and many successful verdicts and settlements.
Most importantly, our team cares about your family. We want to make sure your child has the care they need and the life they deserve. Let us stand by your side on this journey.
How long do I have to file a lawsuit in Pennsylvania?
There is a time limit for filing a lawsuit, called a statute of limitations (SOL). If you are worried about malpractice, call an attorney as soon as possible. An attorney can verify your statute of limitations. Statutes can change, and they differ based on the state and type of facility where your child was born.
In Pennsylvania, parents have two years from the date of the injury to file a claim on their own behalf. For a child injured at birth, parents have until that child’s 20th birthday to pursue a case.
Birth injury lawsuits can take years to finish, so it’s important to speak to a lawyer as soon as possible.

- Cerebral palsy

- A delayed emergency c-section
- Umbilical cord problems
- Infant seizures

- And other birth injuries
NICU Treatment in Pennsylvania
The NICU, or Neonatal Intensive Care Unit, provides supportive services, premature birth care, and breathing assistance. Most providers will use therapeutic hypothermia, also called neonatal cooling, to treat a child diagnosed with HIE. Cooling helps the baby’s brain recover from the injury and minimizes the damage. However, medical staff must treat the baby right after birth.
Not all NICUs can provide this kind of care for HIE. Your child may need to go to another facility for the appropriate treatment. Level III or Level IV NICUs provide the specialized care that a baby with a birth injury typically needs.
Here is a short list of several hospitals in Pennsylvania with Level III or IV NICU designations:
- Children’s Hospital of Philadelphia (CHOP Newborn Care)
- Children’s Hospital of Pittsburgh
- St. Luke’s Hospital-Bethlehem Campus
- Nemours/Alfred I. duPont Hospital for Children at Thomas Jefferson University Hospital
- Chester County Hospital
- PinnacleHealth (Harrisburg).
- Einstein Medical Center (both Philadelphia and Montgomery locations)
