How Long Do I Have to File a Lawsuit in Ohio?
The time limit for filing a lawsuit is called a statute of limitations (SOL). If you suspect malpractice occurred during birth, it’s important to call us as soon as possible. Birth injury lawsuits can take years to finish.
In Ohio, you have until the child’s 19th birthday to file a claim. For an injury to a parent, you have 1 year from the date of the injury to file a claim.

NICU Treatment in Ohio
Babies who experience birth injuries will need treatment from a NICU, or Neonatal Intensive Care Unit. This is a specialized care section of the hospital with equipment for treating infants. The NICU provides supportive services, resuscitation equipment, and treatment for premature babies.
If a child is diagnosed with HIE, most providers will use therapeutic hypothermia, or neonatal cooling. However, there is a short window for this treatment, and the baby must be cooled right after birth. Cooling therapy can help the baby’s brain recover from a brain injury. This treatment can minimize the damage from oxygen deprivation due to trauma during birth.
