How long do I have to file a lawsuit in California?

Unfortunately, there is a time limit for filing a lawsuit, called a statute of limitations. If you suspect malpractice occurred during your child’s birth, contact an attorney as soon as possible. In California, you have until one day before your child’s 8th birthday to file a claim, though some government institutions and state-funded entities have different requirements. Birth injuries in California NICUs

When a baby suffers an injury at birth, they may require special treatment after delivery. These babies are taken to the neonatal intensive care unit (NICU). In California, there are 154 NICUs to care for newborns. 

Depending on the severity of a baby’s injury, they may be taken to a level IV or level III NICU. Level III NICUs provide critical life support and specialists, especially for premature babies. Level IV NICUs can provide the highest level of care for newborns and preemies, especially those that need critical or 24/7 care, pediatric specialists and surgeons, and advanced types of imaging.
