Colorado Birth Injury Lawyers
ABC Law Centers focuses on birth trauma cases to help families nationwide
A birth injury diagnosis is difficult on your whole family. Birth injuries can lead to lifelong disabilities, such as cerebral palsy (CP) and developmental disabilities. A confusing, complicated diagnosis can make the future seem uncertain.
The Colorado birth injury attorneys and supporting staff at ABC Law Centers: Birth Injury Lawyers are here for you.
How can a Colorado birth injury lawyer help?
It can be scary to consider contacting a lawyer about a medical malpractice case. No one wants to be the person filing ridiculous or greedy lawsuits. You may even have a good relationship with your doctor.
However, when mistakes occur – especially ones with long term consequences for your child – you and your family deserve accountability from the hospital.
After a birth injury, your family may need funds for:
- Medical expenses for past and future care
- Physical therapy, occupational therapy, and/or speech therapy
- Assistive equipment for daily life
- Special education support
- Home modifications to ensure your child’s home is accessible to them
You should not have to handle these costs alone. A birth injury lawyer’s goal is to serve you and your family. An attorney advocates for you to have the resources to take care of your child’s complicated needs for life.
It’s not about money – it’s about making sure your child has the best life possible. A consultation with a birth injury lawyer should always be free, with no obligations. Deciding to file a lawsuit is a very personal choice. You have time to learn your options and make an informed decision.

Types of Birth Injury Cases We Handle
Birth injuries are harm caused to the baby at and around the time of birth. Multiple birth injuries may even occur at once. For example, a child may be diagnosed with a lack of oxygen at birth (HIE) at the same time a brain bleed occurs. Birth injuries can result in permanent disabilities for the child.
Our firm has handled cases involving a variety of birth injuries.
Hypoxic-ischemic Encephalopathy
Hypoxic-ischemic encephalopathy (HIE) is a type of brain injury caused by a lack of oxygen or blood flow to the baby. Many pregnancy complications can result in HIE, including factors in a high-risk pregnancy, labor and delivery issues, or medical negligence.
Medical professionals may miss opportunities to prevent HIE or perform negligent actions that cause HIE. If medical professionals do not intervene in time, HIE can cause long term consequences to the baby.
Neonatal Seizures
Neonatal seizures, or seizures in infants, can be difficult to recognize in babies. Seizures involve involuntary jerking movements, which are caused by abnormal electrical patterns in the brain. Seizures can be caused by brain injuries like HIE.
Seizures must be treated immediately, because seizures can cause or worsen brain injuries.
Cerebral palsy
Cerebral palsy is a motor disorder, meaning it affects a child’s ability to move. Children with cerebral palsy may have trouble with muscle stiffness, limpness, difficulty feeding, or even seizures.
Delayed Emergency C-Section
Sometimes, a baby must be delivered immediately via C-section. Several serious complications require emergency delivery, such as placental abruption, uterine rupture, or cord prolapse. If a baby is showing signs of fetal distress, medical staff must act quickly.
If a C-section is delayed by more than 30 minutes, a baby can suffer a brain injury from lack of oxygen.

Do I have a case?
Birth injuries are often preventable with proper vigilance and care from medical staff. Failing to prevent a serious birth injury is medical malpractice.
Birth injuries can take time to discover. A child may begin to grow normally only to start missing developmental milestones. Signs of cerebral palsy or a seizure disorder may be difficult to identify in an infant.
A birth injury lawyer can listen to your situation and find out if medical malpractice or medical negligence occurred. A consultation with an attorney is free.
How long do I have to file a lawsuit?
Unfortunately, there is a time limit for filing a lawsuit. This is called a statute of limitations (SOL). The statute of limitations changes based on the state and what type of facility where the injury occurred. If you suspect malpractice occurred during birth, it’s important to contact an attorney as soon as possible, since birth injury lawsuits can take years to litigate.
A Colorado birth injury lawyer can verify your statute of limitations for you.
NICU Treatment in Colorado
Infants with birth injuries go to the Neonatal Intensive Care Unit (NICU) for treatment. This special unit provides breathing assistance, premature birth care, and other supportive services. To treat conditions like HIE, providers use therapeutic hypothermia, also called neonatal cooling. Neonatal cooling can reduce the damage of a brain injury and help the infant recover.
Not all hospitals have a NICU with equipment to provide therapeutic hypothermia. Level III or Level IV NICUs can provide this special care. If your child needs treatment for HIE, they may have to go to another facility after birth.
Colorado has several hospitals with Level IV or Level III NICUs.
